CMA Defines Ways of Sbmitting Periodic Reports on Capital Adequacy according to its Decision No. 14 of 2007-Thursday 19/4/2007
With reference to CMA Chairman’s Decision No. 14 of 2007regarding issuing capital adequacy rules for securities intermediaries, all such companies with licenses from CMA for practicing securities brokerage, and bond dealing activities, as well as custodians, must submit to CMA statements of net liquid capital using the form attached to the above mentioned decision effective 15/4/2007, and calculated on the basis of Annex (A) of the Decision.
Such companies shall fill out the form on a daily basis and file it along with supporting documents after approval by their officials. They shall also submit the completed form to CMA according to the following instructions:
1-Download net liquid capital calculation form (Click Here-Only Available in Arabic)and save the same on company’s computer
2-Create a special folder for reports submitted to CMA titled “Capital Adequacy Reports. This folder should have two subfolders: “Daily Reports” and “Weekly Reports”.
3-Save the electronic copy of the form on the company’s computer after giving it a unique file name including company name, form type (i.e. weekly or periodical), and     date of financial position that is reported on as follows:
   A-For companies with net liquid capital exceeding 15% or more and obliged to submit the completed form to CMA once a weekly, more specifically on the first workday of the week regarding data of the last workday of the previous week:      Save form in folder called “Weekly Reports” under the name “XYZ_Weekly_12_04_07” where “XYZ” stands for company name, “Weekly”, type of form (in this case,     weekly), and “12_04_07”, data included in form regarding 12 April 2007 and not the day the form is prepared.
   B-For companies with net liquid capital less than 15% on any day and obliged to submit the completed form to CMA on a daily basis regarding data of the previous day:     Save form in folder called “Daily Reports” under the name “XYZ_Daily_12_04_07” where “XYZ” stands for company name, “Daily”, type of form (in this case, daily not     weekly), and “12_04_07”, data included in the form regarding 12 April 2007 and not the day the form is prepared.
4-Submit completed form to CMA according to company’s obligations set forth in CMA Chairman’s Decree No. 14 of 2007 in the following manner and simultaneously:
    A-Send completed form as attachment via company’s e-mail system with the “subject” of the form named as the name of the form. The e-mail     address the form to be sent to is:

    The company must immediately send an official letter to CMA including name of person who prepares the capital adequacy form, telephone and fax numbers,     address of company headquarters that prepares the form, and company e-mail to be used for sending forms periodically. The company mail system should be     protected by passwords that are only known to persons the company officially designated to communicate with CMA and submit completed forms thereto. The     company shall be fully responsible for protecting this e-mail from being accessed by persons other than those it designated for sending completed forms to CMA.
   B. After the company completes and e-mails the form to CMA, it shall print it, get it signed by the person in charge and sealed by company stamp,      and fax it to 02-5370041 with the fax cover prepared by CMA for this purpose (Click Here-Only Available in Arabic)
5-After company sends completed form to CMA via e-mail and fax, it should maintain the original copy of the form and its supporting documents in a special folder that     should be updated constantly in preparation for examination by CMA, or submit the same at request. In addition, the company shall be obliged to maintain daily reports     along with supporting documents regardless of sending them to CMA or not.
